Right to privacy
Yes Unlimited is committed to protecting the privacy of all individuals involved with, or who come in contact with, the organisation. This will include the privacy of children, young people, individuals and families who utilise our services (service users); workers; company directors; and other individuals who come in contact with the organisation in a personal or professional capacity.
Yes Unlimited operates within the Privacy Act 1988 (the Privacy Act). The Privacy Act contains 13Australian Privacy Principles (APPs) which govern how Yes Unlimited may collect, use, disclose and store personal and sensitive information, and how individuals can access and correct records containing their personal or sensitive information.
Yes Unlimited is committed to protecting your privacy in accordance with the APPs.
This document provides information about Yes Unlimited privacy obligations and is a part of our privacy compliance framework. This Policy is to be provided freely to individuals and in such form as is appropriate.
All workers at Yes Unlimited are required to have complete knowledge and understanding of the APPs and to implement them into all practice.
Your right to deal with Yes Unlimited anonymously or pseudonymously
You can deal with Yes Unlimited without identifying yourself or by using a fake name (pseudonym). However, where it is impractical for Yes Unlimited to deal with you in that way, or where the law requires or authorises Yes Unlimited to collect your personal information, Yes Unlimited may require you to identify yourself.
Personal information collected by Yes Unlimited
In order to implement Yes Unlimited policies and program, Yes Unlimited may collect information about individuals. This may include the individual’s name and contact details (such as physical address, mail address, telephone number, and facsimile number). Depending on the program, Yes Unlimited may also collect other personal information. For example, where Yes Unlimited has responsibility for delivery of a service as part of a program, Yes Unlimited may collect information about the individual’s eligibility for that service. If Yes Unlimited coordinates services delivered by another service delivery agency, such as the Department of Family and Community Services, Yes Unlimited may collect the personal information necessary to assess the individual’s eligibility for the service and deliver the service to the individual.
In order to deliver services and program responsibly and meet contractual funding body requirements Yes Unlimited may also collect sensitive information about individuals (such as the individual’s racial or ethnic origin, religious beliefs, membership of professional associations or trade unions, and health information).
In order to maintain current employee information for business and employment related purposes, or where authorised or required by law, Yes Unlimited also collects and holds personnel records. The personal and sensitive information contained in these files relates to Yes Unlimited employees, volunteers and contractors, and may include applications for employment as well as health, financial, educational and/or citizenship information about the employee, volunteer or contractor and their immediate family.
How Yes Unlimited collects personal information
Yes Unlimited may collect personal information about you from a third party in the following limited circumstances:
- it is not practicable or reasonable for Yes Unlimited to collect personal information from you;
- you have consented to the personal information being collected from someone else; or
- Yes Unlimited is authorised or required by law to collect your personal information from someone other than you.
However, outside of these limited circumstances, Yes Unlimited’s practice will be to collect personal information directly from you or your authorised representative where it is necessary for Yes Unlimited’s functions or activities.
Yes Unlimited may also collect sensitive information (such as information about your racial or ethnic origin, political opinions, religious beliefs, membership of professional associations or trade unions, sexual preferences, criminal record, health information, and biometric and genetic information). You will need to consent to this collection, and the information must be reasonably necessary for, or directly related to, one or more of Yes Unlimited’s functions or activities.
On some occasions, Yes Unlimited may collect unsolicited personal or sensitive information (for example, from a third party or from you). When this occurs, as with other records containing personal information, Yes Unlimited will also be required to adhere to the APPs in relation to the collection, use and disclosure of that unsolicited personal information and also the security and access requirements in relation to those records.
Notification of the collection of personal information
When Yes Unlimited collects your personal information directly from you or your authorised representative, Yes Unlimited will notify you of certain information, including:
- the facts and circumstances of the collection;
- whether the collection is authorised or required by law;
- the purpose of the collection;
- the consequences for you if some or all of that personal information is not collected;
- how Yes Unlimited will use and disclose the personal information, including if Yes Unlimited may disclose that information to any other organisations (for example to Australian Government agencies) or overseas recipients;
- That the Yes Unlimited APP Privacy Policy contains information about how individuals can access or seek to change personal information and how an individual can make a complaint about a breach of the APPs and how Yes Unlimited will respond to this.
Yes Unlimited will take reasonable steps to provide this notification before or at the time of collection. If notification is not provided by the time Yes Unlimited collects your personal information, Yes Unlimited will take reasonable steps to provide the notification as soon as practicable after the time of collection.
Yes Unlimited is not required to notify you of matters mentioned above where there are exceptional circumstances, for example, the notification would be inconsistent with a legal obligation or pose a serious threat to a person’s or the public’s health or safety, or may jeopardise the purpose of the collection or the integrity of the information.
Use and disclosure of personal information
Yes Unlimited can use or disclose your personal information for the particular purpose for which it was collected (this is known as the ‘primary purpose’). The primary purpose of collection will depend on the circumstances.
Your personal information may also be used or disclosed for a secondary purpose (that is, a purpose that is different from the primary purpose for which your information was collected) if:
- you give Yes Unlimited permission to use your personal information for that secondary purpose;
- the secondary purpose is related to the primary purpose (or, in the case of your sensitive information, directly related to the primary purpose) and you would reasonably expect Yes Unlimited to use your personal information for that secondary purpose;
- Yes Unlimited is required or authorised by law (for example, under the Child Protection Act 2012) or a permitted general situation exists under the Privacy Act (for example, where it is unreasonable or impracticable to obtain your consent and the use or disclosure of your personal information is necessary to lessen or prevent a serious threat to the life, health or safety of any other individual); or
- Yes Unlimited reasonably believes the use or disclosure is reasonably necessary for one or more enforcement related activities conducted by, or on behalf of, an enforcement body.
Disclosure of personal information overseas
Yes Unlimited does not ordinarily disclose personal information overseas. Yes Unlimited will only disclose an individual’s personal information to an overseas recipient in accordance with the APPs and will ordinarily seek the individual’s permission before doing so.
Integrity of personal information
Yes Unlimited takes reasonable steps to ensure that the personal information it holds, uses and/or discloses is accurate, up-to-date, complete and relevant.
Yes Unlimited also takes reasonable steps to protect the personal information it holds against loss, unauthorised access, use, modification or disclosure, and against other misuse.
Access to, and correction of, personal information
Under the Privacy Act, individuals have rights to access and correct personal information that Yes Unlimited holds about them.
If an individual requests access to the personal information that Yes Unlimited holds about them, or requests that Yes Unlimited change that personal information, Yes Unlimited will allow access or make the changes unless Yes Unlimited consider that there is a sound reason under the Privacy Actor other relevant law to withhold the information or not make the changes.
Yes Unlimited aims to ensure that the personal information it holds is accurate, up-to-date, complete, relevant and not misleading.
